6. Legal Bases Under the GDPR
Where the GDPR applies, VALARTY relies on the legal basis that fits the processing activity. Consent may apply to optional first-party analytics and requested communications. Steps taken at your request before entering a contract may apply to founder, investor, partner or service enquiries. Performance of a contract may apply to signed mandates, portal access or event participation. Legal obligations may apply to accounting, tax, sanctions, corporate, security or compliance records. Legitimate interests may apply to ordinary B2B communications, relationship management, security, fraud prevention, business development, portfolio evaluation and internal operations, balanced against individual rights. Legal claims may require processing for the establishment, exercise or defense of rights.
9. International Data Transfers
VALARTY has an EU headquarters and international operations and counterparties. Personal data may be transferred outside the EEA where providers, offices, investors, founders, advisers or counterparties are located internationally. Where required, safeguards may include European Commission adequacy decisions, the EU-US Data Privacy Framework for participating organizations, Standard Contractual Clauses, supplementary technical and organizational measures, or legally permitted derogations for specific situations.
10. Retention
VALARTY keeps personal data only as long as reasonably necessary for the relevant purpose and legal basis. Unanswered or noncommercial enquiries are normally retained for up to 24 months. Event records are normally retained for up to 24 months after an event unless a longer relationship exists. Business, contractual, investor, due-diligence and transaction records may be retained for the relationship duration plus applicable statutory limitation, accounting, compliance and legal-claim periods. Portal and security logs are kept for a proportionate period based on security needs. Consent records are kept as long as needed to demonstrate compliance. Rejected submissions are deleted or anonymized when no longer necessary, subject to conflict, fraud-prevention and legal-record requirements.
11. Security
VALARTY uses appropriate technical and organizational safeguards designed for a business and investment platform, including access controls, least privilege, authentication for secure portals, encryption where appropriate, monitoring, backup, incident-response planning and vendor governance. No website, email system or portal can be guaranteed to be completely secure.
12. Data Subject Rights
Where the GDPR applies, you may have rights to access, rectify, erase, restrict or object to processing; request portability; withdraw consent; complain to a supervisory authority; and obtain safeguards concerning qualifying automated decisions. The Estonian Data Protection Inspectorate may be the lead supervisory authority where appropriate, without limiting your right to contact another competent EEA authority. VALARTY may request proportionate verification before acting on a rights request.
13. California Privacy Rights
If VALARTY is subject to the California Consumer Privacy Act as amended, California residents may have rights to know, access, delete, correct, opt out of sale or sharing, limit qualifying use of sensitive personal information, and be free from discrimination for exercising rights. The project audit did not confirm advertising pixels or third-party behavioral advertising sales or sharing. If VALARTY later uses technologies that legally constitute sale or sharing, an appropriate opt-out mechanism and Global Privacy Control handling should be implemented.
14. Automated Assessment and Profiling
VALARTY's CRM and DFM code includes scoring, analytics and visitor-intelligence concepts that may support internal prioritization, relationship management or diligence workflows. No decision producing legal or similarly significant effects should be made solely by automated means unless it is separately documented, lawful and disclosed.
